Việt Nam strives to resolve land issues for the interest of all parties

In a recent interview with the media, Politburo member and head of the Party Central Committee's Economic Commission Trần Tuấn Anh discussed the positive changes that resolution No. 18-NQ/TW about land management and use will bring about for people, the State and investors.

Could you please share the practicality of Resolution No. 18 issued in June 16 this year by the fifth plenum of the 13th Party Central Committee?

The resolution specifies the requirement to raise awareness among officials and Party members and people about land use and management in a socialist-oriented market economy as well as the need to strengthen training and education training programmes.

This will help them gain the appropriate and full knowledge about the land under the all-people ownership represented and uniformly managed by the State, especially those on the rights and obligations of the State as the representative of the owner in accordance with the Constitution and the law; rights and obligations of organisations, households and individuals as transferees of land use rights transferred by the State.

This is very important because only when officials, Party members, people and businesses fully understand the content of the resolution, can it be applied properly and timely. It also helps to avoid wrongdoings and violations.

The second point is that the resolution incorporates opinions of the Party on land management and use through national congress sessions of the Party, especially the 13th National Party Congress.

The issuance of the resolution is an important political ground for the continued reform and perfection of land-related mechanisms and policies.

It also helps to solve problems related to the management and use of agricultural and forestry farmland previously owned by the State, land intended for national defence and security in combination with production and economic development purposes, land of production facilities and non-business units that have been moved out of big cities’ centre, land for the ethnic minority groups.

It is important to solve other issues such as land waste; land depletion, pollution and degradation, as well as improve the state management of land, and make sure land is used for the right purpose in an effective and sustainable manner.

It is also crucial to ensure the harmony of interest between people, the State and investors with the two formers being the centre.

What positive changes does the resolution bring to people and investors?

The new directions on land management and use specified in the resolution will have a positive impact on the country’s socio-economic development, the maintenance of security and defence, climate change adaptation as well as ensure the harmony of interest between the State, people and investors.

For people, especially farmers, their interests will be better secured and the use of land is made more flexible. This helps to enhance the land use efficiency thanks to policies that allow more people to have access to assigned agricultural land and increase the quota on the transfer of land.

People also benefit thanks to administrative reforms and the ongoing mechanism for voluntary negotiation between people and businesses involved in the transfer of rights to use the land for the development of urban and commercial housing projects.

The livelihoods of people whose land is appropriated are better cared for and guaranteed thanks to more specific regulations.

They also benefit from the development of the agricultural land rental market and the perfection of the land use tax policies.

Investors will be more proactive in their investment and production activities as they are aware of auctions of land use rights; bids for implementation of projects using the land. They can access land more flexibly thanks to the policies that allow more people to have access to assigned agricultural land and increase the quota on the transfer of land as well as the development of the agricultural land rental market.

They can also cut down on land use costs thanks to improved land-related administrative procedures.

They are also beneficiaries as the supervision, inspection work and handling of violations are reformed and strengthened, the prevention of and fight against corruption are tightened, and land speculation and land waste are limited thanks to specific and tight punishments.

How does the resolution impact the State management and planning of land use?

The State will receive more budget thanks to some land appropriation and land auction policies, and new land tax policies.

Notably, the State can ensure stability and social equality when issues related to residence and production land for the ethnic minority group are settled. It can also ensure land used for social housing projects, financial preference policies for the remote, disadvantaged areas.

The State can also ensure better efficiency in its management thanks to improved land use planning, a modernised land database and information system, and a more effective land management mechanism.

The legalisation of the directions in the resolution will create a legal corridor ensuring the State has the tools needed to exercise its rights and obligations as the representative of the owner.

Ensuring harmony of interest between people, investors and the State in land use and management will also help to minimise waste and wrongdoings, and reduce disputes, complaints, accusations and violations against law on land. VNS
