Jail term upheld in tax fraud case

HA NOI (VNS)— The Court of Appeal at the Supreme People's Court in Ha Noi confirmed a 30-month jail sentence for Le Quoc Quan for tax evasion pursuant to Clause 3, Article 161 of the Criminal Code yesterday.

According to the indictment, the 43-year-old set up the Vietnam Solution Co Ltd in April 2001 in Cau Giay District, Ha Noi .

Under its business registration, the company was involved in a range of activities including investment consultancy, labour and vocational training services, electrical engineering and technology related to agriculture and rural development.

The company changed its business registration certificate 13 times, with the last adding data uploading, searching, storing and processing to its portfolio.

Quan, as the company director, instructed his accountant Pham Thi Phuong to make fake contracts and buy fake invoices in order to evade corporate income tax.

After the hearing, the board of judges decided to turn down Quan's appeal and confirmed the 30-month sentence handed down in the first trial on October 2, 2013.

The court also instructed Quan's company to pay back corporate income tax amounting to VND645 million (US$30,700) on top of a fine of more than VND1.29 billion ($61,428). — VNS
