REQUEST FOR EXPRESSION OF INTEREST FOR INVESTMENT PROJECTS USING LAND

Attn: Investors with interests

 

The Department of Planning and Investment of Thua Thien Hue province invites investors with interests to submit project registration dossier for the project of Thua Thien Hue Centralized Information Technology and Software Park (Smart Communications City) in Zone B – An Van Duong New Urban Area, Thua Thien Hue province as follows:

1. Project objectives and scope:

1.1. Thua Thien Hue Centralized Information Technology and Software Park is implemented for the following main objectives:

- To form a city of information technology, create infrastructure for information technology application and development; promote the development of information technology on the basis of culture and knowledge. To become the hub for research and development of information technology products serving the training and technology transfer in the information technology field; and business incubation. In addition, to become the hub to provide synchronous and modern infrastructure and services of information technology and communications.

- To create a favorable environment for investment activities to attract domestic and foreign capital and technology, contributing to building the information technology industry into a key and important industry of the country; To create a working environment of international standards, attracting high-quality workforce, contributing to improving the competitiveness of Vietnamese information technology companies; To create information technology products and services that can replace imported products, contributing to promoting the development of the following fields: financial telecommunications, banking, customs, aviation, commerce, e-commerce, public services, education and training, health, security, and defense.

- To contribute to the economic growth, improve the level of technology, production and competitiveness of Vietnamese companies’ products, goods and services, and to enhance the position and brand of Vietnamese information technology.

1.2. Project scope:

- Number of experts and workers: about 5,000 people.

- Land area: The total area of the project site is 39.6 hectares.

In which, 2 main functional subzone groups shall be available as follows:

- A subzone group performing the functions and tasks of the information technology park includes:

+ A subzone of manufacture and information technology products and services trade; A subzone of research - development, consultancy, training, information technology incubation; A subzone of offices, head offices for management and administration; A subzone of focal point for technical infrastructure works such as electricity, water, telecommunications, environmental treatment, fire prevention and other technical infrastructure; A subzone of display areas, fairs, exhibitions, product introduction and communications; A subzone of other functions carrying out the functions of the centralized information technology park.

- A subzone group providing services for the centralized information technology park includes:

+ A subzone of ecological and residential services; A subzone of finance or affiliate finance, banking; A subzone of houses for experts working in the centralized information technology park (not for construction of commercial houses); A subzone of other functions providing services for the centralized information technology park.

2. Preliminary total investment: about VND 3,458 billion, in which:

- Total preliminary cost of the project (excluding site clearance and compensation cost) (m1): about VND 3,367 billion.

- Site clearance and compensation cost (including resettlement support cost) (m2): about VND 91 billion.

3. Term of land allocation/land lease: In compliance with the Land Law.

4. Project schedule: No more than 72 months. Time of project investment is counted from the date of handing over the land at the site; in which:

- Time for completing technical infrastructure shall not exceed 24 months.

- Time for completing technical works on the land shall not exceed 48 months, during this period, the following tasks shall be executed:

+ The investment in major works to ensure the project's operational functions shall not exceed 36 months, including: the subzone group performing functions and tasks of the centralized information technology park and the subzone group providing services for the centralized information technology park according to the Decree No. 154/2013/ND-CP dated November 08, 2013 of the Government on centralized information technology parks.

+ Investment in the remaining works shall comply with the planning; and calling for organizations and companies to implement new investment projects in the information technology field.

Investors shall urgently follow project implementation procedures to ensure the above schedule. The project can be considered for an extension of the implementation time in objective situations in accordance with the law and approved by competent authorities. In case of subjective errors of investors, the project will not be considered for an extension of the implementation schedule and revoked in accordance with relevant laws.

5. Project site: The lot marked with notation CNTT, CX-MN, CX-CL in Zone B – An Van Duong New Urban Area, Thuy Van commune, Huong Thuy town.

- The North borders a 60m planned road;

- The South borders a green park area;

- The East borders a planned Thuy Duong – Thuan An road;

- The West borders Thuy Van Complex – Phase 2.

6. Land area: The total area of the project site is 39.6 hectares.

7. Land use purposes: Investment and construction of Thua Thien Hue centralized information technology and software park.

8. Deadline for project registration dossier submission: 30 days from the date of publication of the list of projects on the National Bidding Network System. Specifically, the date to submit the project registration dossier is from 19/02/2021 (dd/mm/yyyy) to 15 hr 00 mn, 26/3/2021 (dd/mm/yyyy).

Investors shall submit expression of interest including: 01 original, 05 sealed and confidential copies.

9. Method of opening expression of interest: Upon the deadline mentioned in Section 8 above, the Department of Planning and Investment will invite relevant agencies, investors submitting expression of interest to attend the expression of interest opening ceremony as the basis for dossier evaluation according to the Decision No. 2880/QD-UBND dated November 13, 2020 of the People's Committee of Thua Thien Hue province on the approval of investment project using land and needing investors for the project of Thua Thien Hue Centralized Information Technology and Software Park (Smart Communications City) in Zone B – An Van Duong New Urban Area.

12. Investors who are interested and wish to register for project implementation, must follow the procedures to be issued digital certificates and submit their project registration dossier on the National Bidding Network System.

 

APPENDIX

Preliminary requirements on capability and experience of investors registering for project implementation 

Project name: Thua Thien Hue Centralized Information Technology and Software Park (Smart Communications City) in Zone B – An Van Duong New Urban Area.

Issued together with the Decision No. 2880/QD-UBND dated November 13, 2020 of the People's Committee of Thua Thien Hue province on the approval of investment project using land and needing investors for the project of Thua Thien Hue Centralized Information Technology and Software Park (Smart Communications City) in Zone B – An Van Duong New Urban Area.

 

CHAPTER I. GUIDELINES FOR INVESTORS

 

Section 1. Invitation for expression of interest

1. The Department of Planning and Investment of Thua Thien Hue province invites investors to submit project registration dossier for the project of Thua Thien Hue Centralized Information Technology and Software Park (Smart Communications City) in Zone B – An Van Duong New Urban Area, Thua Thien Hue province.

2. Project information:

2.1. Project name: Thua Thien Hue Centralized Information Technology and Software Park (Smart Communications City) in Zone B – An Van Duong New Urban Area, Thua Thien Hue province.

2.2. Project objectives: The project of Thua Thien Hue Centralized Information Technology and Software Park aims for the following objectives:

- To form a city of information technology, create infrastructure for information technology application and development; promote the development of information technology on the basis of culture and knowledge. To become the hub for research and development of information technology products serving the training and technology transfer in the information technology field; and business incubation. In addition, to become the hub to provide synchronous and modern infrastructure and services of information technology and communications.

- To create a favorable environment for investment activities to attract domestic and foreign capital and technology, contributing to building the information technology industry into a key and important industry of the country; To create a working environment of international standards, attracting high-quality workforce, contributing to improving the competitiveness of Vietnamese information technology companies; To create information technology products and services that can replace imported products, contributing to promoting the development of the following fields: financial telecommunications, banking, customs, aviation, commerce, e-commerce, public services, education and training, health, security, and defense.

2.3. Project scope:

2.4. Preliminary total investment: about VND 3,458 billion, in which:

- Total preliminary cost of the project (excluding site clearance and compensation cost) (m1): about VND 3,367 billion.

- Site clearance and compensation cost (including resettlement support cost) (m2): about VND 91 billion.

2.5. Investment capital and capital mobilization: Owner’s equity of investors and capital mobilized by investors from other lawful sources.

2.6. Project site: The lot marked with notation CNTT, CX-MN, CX-CL in Zone B – An Van Duong New Urban Area, Thuy Van commune, Huong Thuy town.

- The North borders a 60m planned road;

2.10. Current status of the land: The land belongs to the administrative boundary of Thuy Van commune, Huong Thuy town, Thua Thien Hue province.  The majority is rice-growing land and field ditches.

         2.11. Architectural construction planning criteria: Pursuant to the Decision No. 2287/QD-UBND dated September 17, 2019 on the approval of the (partial) adjustment of the Detailed planning of Zone B – An Van Duong New Urban Area, Thua Thien Hue province,

- Planning critreria of the land marked with CNTT notation:

+ Building density: ≤ 40%.

+ Building height: For the 60m planned road and Thuy Duong – Thuan An road, the maximum number of floors is 25 floors; For other roads, the maximum number of floors is 15 floors.

+ Floor area ratio: ≤ 1.2 times.

+ Building lines: ≥ 10m from the red line boundaries of 60m and 36m planned roads; ≥ 6m from the red line boundaries of other roads.

- A subzone of residential houses and apartments (if any) accounts for a maximum of 20% of the land marked with CNTT notation.

2.12. Investment incentives:

The investor selected to execute the project is responsible for constructing and completing the project in accordance with the functions, tasks, criteria and planning of Thua Thien Hue Centralized Information Technology and Software Park, approved by the Prime Minister in the Decision No. 1898/QD-TTg dated December 25, 2019 on the admission of Thua Thien Hue Center for Information Technology as a member of Quang Trung Software City Chain.

After the construction project is completed and put into operation, competent authorities have the rights to inspect and verify that the project facilities meet the criteria of the approved planning and the project meets the criteria of centralized information technology parks as stipulated in the Decree No. 154/2013/ND-CP dated November 08, 2013 of the Government, it will enjoy incentive policies for centralized information technology parks and other incentive policies of relevant laws.

2.13. Deadline for project registration dossier submission: 30 days from the date of publication of the project on the National Bidding Network System.

2.14. Location for project registration dossier submission: Department of Planning and Investment of Thua Thien Hue province

Section 2. Preliminary requirements on capability and experience of investors

The preliminary requirements on capability and experience of investors include requirements on capability and experience. Details are in Chapter II.

Section 3. Clarification of preliminary requirements on capability and experience of investors

1. In cases where investors want to clarify the preliminary requirements on capability and experience, investors must submit requests for clarification to the Department of Planning and Investment in writing or through the National Bidding Network System at least 05 working days before the deadline for project registration dossier submission for consideration and handling.

2. After receiving the written request for clarification within the prescribed time, the Department of Planning and Investment shall clarify and post it on the National Bidding Network System at leaste 02 working days before the deadline for project registration dossier submission. The clarification shoul include a description of the content requested to be clarified but not the name of investors requesting the clarifications. In cases where the clarifications lead to the need to modify the preliminary requirements on capability and experience, the provisions of Section 4 of this Chapter shall apply.

Section 4. Modification of preliminary requirements on capability and experience of investors

1. In case of modification of the preliminary requirements on capability and experience, the Department of Planning and Investment shall post the decision on the amendment as well as the amended content on the National Bidding Network System at least 10 days before the deadline for project registration dossier submission.

2. If the announement time of amendments to preliminary requirements on capability and experience does not satisfy the provisions of Section 4.1, the Department of Planning and Investment shall implement the time for submitting corresponding project registration dossier to ensure the above regulations. The extension is made in accordance with Section 6.3.

Section 5. Language

The project registration dossier as well as all correspondence and documents exchanged between investors and the Department of Planning and Investment are written in Vietnamese and English or English. Documents and supporting materials in the project registration dossier can be written in a foreign language attached with a Vietnamese translation. If no translations are available, if needed, the Department of Planning and Investment of Thua Thien Hue province can request the investors to add.

Section 6. Project registration dossier and deadline

1. The project registration dossier prepared by investors must include the relevant forms and documents as prescribed in Chapter III.

2. Investors submit project registration dossier on the National Bidding Network System before ___ hours, date ___ month ___ year ___ . [Specify the deadline for project registration dossier submission, ensuring at least 30 days from the date the list of projects is posted].

3. The Department of Planning and Investment may extend the deadline for project registration dossier submission in cases where there are admenments in the preliminary requirements on capability and experience of investors as prescribed in Section 4 of this Chapter; it is necessary to increase the number of investors as prescribed in Point b Clause 2 Section 9 of this Chapter or other necessary cases. Upon extension, the Department of Planning and Investment of Thua Thien Hue province will post an announcement on the National Bidding Network System and notify the appling investors (if any) of the deadline for project registration dossier submission.

Section 7. Modification and replacement of the project registration dossier

After the submission, investors can replace or modify the project registration dossier by supplementing relevant documents and materials to the National Bidding Network System before the deadline for project registration dossier sumission.

Section 8. Clarification of the project registration dossier

Investors are responsible for clarifying submitted project registration dossier at the request of the Department of Planning and Investment. All requests for clarification and feedbacks of investors must be made on the National Bidding Network System.

Section 9. Announcement about the results of preliminary evaluation on capability and experience of investors

1. Upon the results of the preliminary evaluation on capability and experience of investors, the Department of Planning and Investment will post a list of qualified investors on the National Bidding Network System.

2. If only one investor meets the requirements, before posting information according to Clause 1 of this Section, the Department of Planning and Investment shall report to the Chairperson of the provincial People’s Committee for consideration and decision with either the following options:

a) Option 1: Notify and guide the investor to submit the investment policy decision in accordance with the Law on Investment and other relevant laws as prescribed in Point b Clause 3 Article 13 of the Decree No. 25/2020/ND-CP.

b) Option 2: Extend the deadline for project registration dossier submission. The extended deadline shall be decided by the Chairperson of the Provincial People's Committee and announced on the National Bidding Network System. The investor who has satisfied the requirements is not required to re-submit the project registration dossier.

Upon the extension, if there are more investors meeting the preliminary requirements on capability and experience, Clause 3 of this Section shall apply. In cases where there are no more investors who satisfy the preliminary requirements on capability and experience, the provisions of Point a of this Clause shall apply.

3. If two or more investors satisfy the requirements, the investor selection will be conducted in the form of open bidding as prescribed at Point a, Clause 3, Article 13 of the Decree No. 25/2020/ND-CP. Bidding documents are distributed to investors, including those not on the list of investors who have met preliminary requirements for capability and experience.

 


CHAPTER II. PRELIMINARY REQUIREMENTS ON CAPABILITY AND EXPERIENCE OF INVESTORS

Financial capability

Investors' remaining equity must be VND 519 billion at a minimum (not lower than 15% of the total investment for projects with land use of 20 hectares or more).

In the case of a joint venture, the remaining equity of the joint venture investor is equal to the total equity of joint venture members, which is VND 519 billion at a minimum. In addition, each joint venture member must meet the requirement in proportion to the equity contribution according to the joint venture agreement. If any joint venture members are deemed unqualified, joint venture investors shall be deemed not to meet the equity requirement.

The investor leading a joint venture must own a minimum equity ratio of 30%, each joint venture member must own a minimum equity ratio of 15% in the joint venture.

 

Experience

A minimum number of projects that investors or joint venture members or their implementing partners who have participated as main contractors or investors contributing the equity: 01 project. Classify the project according to one of the following classes:

- Class 1: Projects in fields of centralized information technology park, information technology valley; multi-purpose buildings, multi-purpose complexes for business purposes in which investors have participated as investors contributing the equity and fully met the following conditions:

+ Projects with total investment of VND 2,421 billion at a minimum (equivalent to 70% of the total investment of the considered project).

+ Projects in which investors have minimum equity value of VND 364 billion (equivalent to 70% of the equity requirement of the considered project).

+ Projects whose construction stage have been completed in the last 07 years from 2014 to 2020.

- Class 2: Projects in fields of centralized information technology parks, information technology valleys; multi-purpose buildings, multi-purpose complexes for business purposes in which investors have participated as main contractors implementing construction and installation bidding packages and fully met the following conditions:

+ Work value of investors in bidding packages/contracts is at least VND 1,729 billion (equivalent to 50% of the respective work value of the considered project).

+ Bidding packages/contracts have ended in the last 07 years from 2014 to 2020.

- Class 3: Projects in fields of centralized information technology parks, information technology valleys; multi-purpose buildings, multi-purpose complexes for centralized information technology business purposes in which implementing partners have participated as main contractors implementing construction and installation bidding packages and fully met the following conditions:

+ Work value of implementing partners in bidding packages/contracts is at least VND 1,040 billion (equivalent to 30% of the respective work value of the considered project).

+ Bidding packages/contracts haveended in the last 07 years from 2014 to 2020.

Experience of investors is reflected in the number of projects which is the total number of projects that have been implemented by investors/ joint venture members and partners.

The projects/ bidding packages of investors/ implementing partners can only be considered and evaluated when they meet technical and quality requirements according to their signed contracts.

 

Notes:

- If investors are organizations established in this year, the investors’ financial capability shall be evaluated based on their financial statements audited by independent auditing firms from the date of their establishment to no more than 28 days before the deadline for project registration dossier submission.

- Investors’ equity is determined based on financial data of investors which is updated within no more than 28 days before the deadline for project registration dossier submission and the commitment of equity mobilization of investors. Investors must provide information and documents about their financial capability in accordance with the Form No. 02 in Chapter III.

- Investors’ remaining equity = Total equity - Costs related to litigation - Committed equity for other ongoing projects and long-term investments (if any) - Equity retained in accordance with regulations (Equity is used exclusively for allocation or according to legal requirements to investors; Equity must be retained according to special contingency requirements for possible circumstances; Other equity is committed to be returned and not used in dividend declarations, etc.).

- Investors’ experience must be provided in accordance with Form No. 03 in Chapter III. Investors are only allowed to state their own experience of similar project implementation only once.

- Partners implementing project include: Financial institutions; Building contractors; Operating, management contractors.

- Project converting method: stipulated that 01 (one) Class 2 project is equal to 0.7Class 1 project and rounding shall be performed when the total number of projects is an odd number.

- Project converting method: stipulated that 01 (one) Class 3 project is equal to 0.5 Class 1 project and rounding shall be performed when the total number of projects is an odd number.

Investors must provide minutes of acceptance, liquidation of contracts or certifications issued by competent authorities to demonstrate their fulfillment of technical and quality requirements for the implemented projects/bidding packages.

Notes:

(1) In case of a joint venture, each joint venture member shall declare information using this Form. In addition, investors shall attach a copy of an agreement of joint venture members on the project implementation, in which, the expected ratio of capital contribution in the joint venture shall be clearly stated.

Attached is documents proving the financial data of the investor updated within no more than 28 days before the deadline for project registration dossier submission:

- Copies of audited financial statements within 28 days before the deadline for project registration dossier submission (investors can use annual financial statements, mid-year financial statements, report on equity use).

Reports provided by investors shall comply with legal provisions on finance and accounting and reflect the financial capability of investor sor joint venture members (for joint venture investors), not the financial capability of associated entities such as parent company or subsidiaries or company associated with investors and joint venture members.

- If the period of 28 days before the deadline for project registration dossier submission does not coincide with any accounting period or the investor does not have any audited financial statements within this period, investors must provide the latest audited financial statements.

Moreover, investors shall state and provide documents proving there are changes in the financial data from the date of the audit report to the date of bidding (e.g. supporting documents for the equity increase). Investors shall be responsibe for the declared information. If the declared information is found to be inaccurate or falsifying the evaluation results, the investor shall be handled according to regulations.

- If investors have just been established in this year, they shall submit financial statements audited by an independent auditing firm from the date of their establishment to no more than 28 days before the deadline for project registration dossier submission.

(1) In the case of a joint venture, each joint venture member shall declare information using this Form.

(2) Based on evaluation criteria, appropriate information shall be supplemented.

Pursuant to the Law on Organization of local governments dated June 19, 2015;

Pursuant to the Law on Bidding dated November 26, 2013;

Pursuant to the Law on Housing dated November 25, 2014;

Pursuant to the Law on Investment dated November 26, 2014;

Pursuant to the Land Law dated November 29, 2013;

Pursuant to the Decree No. 118/2015/ND-CP on November 12, 2015 of the Government detailing and guiding the implementation of some articles of the Law on Investment;

Pursuant to the Circular No. 06/2020/TT-BKHDT dated September 18, 2020 of the Ministry of Planning and Investment guiding the implementation of the Decree No. 25/2020/ND-CP dated February 28, 2020 of the Government, detailing the implementation of some articles of the Law on Bidding regarding investor selection;

Pursuant to the Decision No. 44/QD-BXD dated January 14, 2020 of the Ministry of Construction on the announcement of work construction investment unit cost and general construction cost of structural components in 2018;

Pursuant to the Decision No. 1074/QD-SXD April 13, 2020 of the Department of Construction on the announcement of construction price index in January, February and March; Quarter I/2020 in Thua Thien Hue province;

Pursuant to the Decision No. 196/QD-UBND dated January 22, 2009 of the People's Committee of Thua Thien Hue province on the approval of the detailed planning (scale 1/2000) of Zone B – An Van Duong New Urban Area, Thua Thien Hue province;

Pursuant to the Decision No. 2287/QD-UBND dated September 17, 2019 of the Provincial People's Committee on the (partial) adjustment of the detailed planning of Zone B - An Van Duong New Urban Area, Thua Thien Hue province;

  Pursuant to the Decision No. 1508/QD-UBND dated June 24, 2019 of the People's Committee of Thua Thien Hue province on the adjustment of the list of projects calling for investment and supplementation of information for projects calling for investment of Thua Thien Hue province in 2019 and orientation to 2020;

Pursuant to the Decision No. 368/QD-UBND dated February 05, 2020 of the People's Committee of Thua Thien Hue province on the approval of the 2020 land use plan of Huong Thuy town;

Considering the Statement No. 1543/TTr-STTTT dated July 29, 2020 of the Department of Information and Communications on the approval of investment projects using land and needing investors for the project of Thua Thien Hue Centralized Information Technology and Software Park (Smart Communications City) in Zone B – An Van Duong New Urban Area, Thua Thien Hue province;

At the recommendation of Director of the Department of Planning and Investment in the Statement No. 3631/TTr-SKHDT dated November 6, 2020.

 

HEREBY DECIDES:

Article 1. To approve investment projects using land and needing investors for the project of Thua Thien Hue Centralized Information Technology and Software Park (Smart Communications City) in Zone B – An Van Duong New Urban Area, Thua Thien Hue province as follows:

  1. Project name: Thua Thien Hue Centralized Information Technology and Software Park (Smart Communications City) in Zone B – An Van Duong New Urban Area, Thua Thien Hue province.

2. Project objectives: The project of Thua Thien Hue Centralized Information Technology and Software Park aims for the following objectives:

- To form a city of information technology, create infrastructure for information technology application and development; promote the development of information technology on the basis of culture and knowledge. To become the hub for research and development of information technology products serving the training and technology transfer in the information technology field; and business incubation. In addition, to become the hub to provide synchronous and modern infrastructure and services of information technology and communications.

- To create a favorable environment for investment activities to attract domestic and foreign capital and technology, contributing to building the information technology industry into a key and important industry of the country; To create a working environment of international standards, attracting high-quality workforce, contributing to improving the competitiveness of Vietnamese information technology companies; To create information technology products and services that can replace imported products, contributing to promoting the development of the following fields: financial telecommunications, banking, customs, aviation, commerce, e-commerce, public services, education and training, health, security, and defense.

- To contribute to the economic growth, improve the level of technology, production and competitiveness of Vietnamese companies’ products, goods and services, and to enhance the position and brand of Vietnamese information technology.

3. Project scope:

- Number of experts and workers: about 5,000 people.

- Land area: The total area of the project site is 39.6 hectares.

In which, 2 main functional subzone groups shall be available as follows:

a) A subzone group performing the functions and tasks of the centralized information technology park includes:

- A subzone of manufacture and information technology products and services trade; A subzone of research - development, consultancy, training, information technology incubation; A subzone of offices, head offices for management and administration; A subzone of focal point for technical infrastructure works such as electricity, water, telecommunications, environmental treatment, fire prevention and other technical infrastructure; A subzone of display areas, fairs, exhibitions, product introduction and communications; A subzone of other functions carrying out the functions of the centralized information technology park.

b) A subzone group providing services for the centralized information technology park includes:

- A subzone of ecological and residential services; A subzone of finance or affiliate finance, banking; A subzone of houses for experts working in the centralized information technology park (not for construction of commercial houses); A subzone of other functions providing services for the centralized information technology park.

4. Preliminary total investment: about VND 3,458 billion, in which:

- Total preliminary cost of the project (excluding site clearance and compensation cost) (m1): about VND 3,367 billion.

- Site clearance and compensation cost (including resettlement support cost) (m2): about VND 91 billion.

5. Investment capital and capital mobilization: Owner’s equity of investors and capital mobilized by investors from other lawful sources.

6. Project site: The lot marked with notation CNTT, CX-MN, CX-CL in Zone B – An Van Duong New Urban Area, Thuy Van commune, Huong Thuy town.

- The North borders a 60m planned road;

- The South borders a green park area;

- The East borders a planned Thuy Duong – Thuan An road;

- The West borders Thuy Van Complex – Phase 2.

7. Project schedule: No more than 72 months. Time of project investment is counted from the date of handing over the land at the site; in which:

- Time for completing technical infrastructure shall not exceed 24 months.

- Time for completing technical works on the land shall not exceed 48 months, during this period, the following tasks shall be executed:

+ The investment in major works to ensure the project's operational functions shall not exceed 36 months, including: the subzone group performing functions and tasks of the centralized information technology park and the subzone group providing services for the centralized information technology park according to the Decree No. 154/2013/ND-CP dated November 08, 2013 of the Government on centralized information technology parks.

+ Investment in the remaining works shall comply with the planning; and calling for organizations and companies to implement new investment projects in the information technology field.

Investors shall urgently follow project implementation procedures to ensure the above schedule. The project can be considered for an extension of the implementation time in objective situations in accordance with the law and approved by competent authorities. In case of subjective errors of investors, the project will not be considered for an extension of the implementation schedule and revoked in accordance with relevant laws.

8. Term of land allocation/land lease: In compliance with the Land Law.

9. Land use purposes: Investment and construction of Thua Thien Hue Centralized Information Technology and Software Park.

  10. Current status of the land: The land belongs to the administrative boundary of Thuy Van commune, Huong Thuy town, Thua Thien Hue province.  The majority is rice-growing land and field ditches.

  11. Architectural construction planning criteria: Pursuant to the Decision No. 2287/QD-UBND dated September 17, 2019 on the approval of the (partial) adjustment of the Detailed planning of Zone B – An Van Duong New Urban Area, Thua Thien Hue province.

12. Requirements on architectural plans and operational capability:

- Investors must have an architectural plan to ensure the harmony with surrounding buildings and respect the landscape of the neighboring areas. Investors must have the architectural plan certified by the Department of Construction before carrying out procedures for construction investment.

- Investors shall have appropriate project operation and management plans which can prove their feasibility.

13. Requirements on environmental and safety:

- Changes of natural terrain and landscape (if necessary) such as: backfilling of land areas, lakes, ponds, trees, water surfaces (if any) must comply with the approved planning scheme.

- The management and construction must comply with the professional regulations, principles and standards to control and ensure the urban environmental protection in the planned area.

- Investors must have solutions to minimize and overcome impacts on local residents and natural landscape; air and noise pollution during the project implementation.

- Air and environment protection: Planting trees on both sides of roads, parks and green spaces.

14. Investment incentives:

The investor selected to execute the project is responsible for constructing and completing the project in accordance with the functions, tasks, criteria and planning of Thua Thien Hue Centralized Information Technology and Software Park, approved by the Prime Minister in the Decision No. 1898/QD-TTg dated December 25, 2019 on the admission of Thua Thien Hue Center for Information Technology as a member of Quang Trung Software City Chain.

After the construction project is completed and put into operation, competent authorities have the rights to inspect and verify that the project facilities meet the criteria of the approved planning and the project meets the criteria of centralized information technology parks as stipulated in the Decree No. 154/2013/ND-CP dated November 08, 2013 of the Government, it will enjoy incentive policies for centralized information technology parks and other incentive policies of relevant laws.

15. Deadline for project registration dossier submission: 30 days from the date of publication of the list of projects on the National Bidding Network System.

16. Role of Thua Thien Hue Center for Information Technology in the Project Thua Thien Hue Centralized Information Technology and Software Park (Smart Communications City) in Zone B – An Van Duong New Urban Area:

- The Center for Information Technology plays the role of an advisor in project appraisal in order to fully comply with the functional subzones of the centralized information technology park as stipulated in the Decree No. 154/2013/ND-CP dated November 08, 2013 of the Government to become a member of Quang Trung Software City Chain.

- The Center for Information Technology is responsible for managing  the entire project site according to the model of Quang Trung Software City Chain; performing the role of a supervisor and manager for the projects proposing investment in Thua Thien Hue Centralized Information Technology and Software Park (Smart Communications City) in Zone B – An Van Duong New Urban Area according to the approved planning; assisting investors in carrying out procedures for investment, land, and construction, as well as fulfilling the functions stipulated in Clause 3 Article 24 and Point b Clause 4 Article 27 of the Decree No. 154/2013/ND-CP of the Government; serving the functions and tasks stipulated in Clause 8 Article 2 of the Decision No. 1972/QD-UBND dated August 04, 2020 of the Provincial People's Committee on the functions, tasks, powers, and organizational structure of Thua Thien Hue Center for Information Technology.

Article 3. The Head of the Office of the Provincial People’s Committee, the Directors of the Departments of: Planning and Investment, Construction, Natural Resources and Environment, Finance, Information and Communications; the Chairperson of the People's Committee of Huong Thuy town; the Director of the Urban Development Area Management Board and Heads of relevant authorities shall abide by this Decision./.
